Perkembangan teknologi informasi telah mendorong transformasi dalam berbagai aspek kehidupan, termasuk dalam aktivitas perjanjian hukum yang kini dapat dilakukan secara elektronik. Kajian ini membahas aspek hukum kontrak elektronik di Indonesia, dengan menelaah landasan hukum, prinsip-prinsip yang berlaku, serta tantangan yang dihadapi dalam implementasinya. Berdasarkan analisis terhadap regulasi yang berlaku, seperti Undang-Undang Informasi dan Transaksi Elektronik (UU ITE) serta peraturan terkait lainnya, ditemukan bahwasanya perjanjian elektronik mempunyai kekuatan hukum yang setara dengan perjanjian konvensional, selama memenuhi unsur kesepakatan, kecakapan, objek yang sah, dan sebab yang tidak dilarang oleh hukum. Namun, masih terdapat tantangan dalam aspek perlindungan konsumen, keamanan data, dan pembuktian dalam sengketa hukum. Kajian ini diharapkan dapat memberikan wawasan mengenai perkembangan regulasi kontrak elektronik serta solusi atas permasalahan yang dihadapi dalam implementasinya di Indonesia.
Abstract
The development of information technology has encouraged transformation in various aspects of life, including in legal agreement activities which can now be carried out electronically. This paper discusses the legal aspects of electronic contracts in Indonesia, by examining the legal basis, applicable principles, and challenges faced in its implementation. Based on the analysis of applicable regulations, such as the Electronic Information and Transaction Law (ITE Law) and other related regulations, it is found that electronic contracts have the same legal force as conventional contracts, as long as they fulfill the elements of agreement, capability, valid object, and cause that is not prohibited by law. However, there are still challenges in the aspects of consumer protection, data security, and proof in legal disputes. This study is expected to provide insight into the development of electronic contract regulations as well as solutions to the problems faced in its implementation in Indonesia.
